Garda Joseph Joyce loses discrimination claim over pandemic work‑from‑home order
The Workplace Relations Commission (WRC) ruled that the Garda Commissioner did not breach the Employment Equality Act in the case of Garda Joseph Joyce, a veteran officer with severe asthma and COPD. Joyce had been allowed to work from home during the COVID‑19 pandemic but was ordered back to frontline duties in January 2022, prompting him to take sick leave for stress‑related illness.
WRC adjudicator Penelope McGrath found the process for returning Joyce to duty was “very badly organised” and noted that he was not provided reasonable accommodation. However, the tribunal dismissed his equality complaint because it was filed outside the six‑month time limit, concluding that no discrimination occurred in the period before the complaint was lodged.
