Gauhati High Court flags misuse of law in Assam house demolitions

The Gauhati High Court has observed that the Assam administration appears to be “misusing” the law regarding the demolition of 21 dwelling units on private agricultural land in the Goalpara district.

Justice Devashis Baruah stated that, prima facie, there was no imminent danger to justify the destruction of the homes. The court noted that the actions appeared to be a misuse of the Disaster Management Department Act, 2005. The petitioners, who are Muslim, had their houses razed on September 7 after being given only 24 hours to demolish them voluntarily.

The court has granted the district commissioner and the circle officer an opportunity to file affidavits. Following their response, the court will decide on potential compensation for the victims if the demolition is found to be unauthorized by law. The next hearing is scheduled for October 13.
