German Bundesrat challenges EU Affordable Housing Act

The German Bundesrat has submitted a subsidiarity complaint to the European Commission regarding the proposed 'Affordable Housing Act'. The German states argue that the EU is overstepping its authority by attempting to establish uniform European rules for housing markets, specifically concerning the restriction of short-term tourist rentals.

Critics, including North Rhine-Westphalia's Building Minister Ina Scharrenbach, contend that housing policy should remain under the jurisdiction of national, regional, and local authorities. There are concerns that the EU mandate would impose significant bureaucratic burdens on municipalities, requiring them to collect and evaluate new types of data.

The proposed EU legislation defines areas of 'housing market stress' as regions where housing purchase prices have exceeded eight times the local income for a period of ten years. In such areas, the act would allow for stricter regulations against short-term rentals to alleviate pressure on local housing supplies.
