German politicians debate Basic Law amendment for sexual identity protection

German political leaders are divided over a proposal to amend Article 3 of the Basic Law (Grundgesetz) to include protection against discrimination based on sexual identity. The debate has intensified following an attack at a Christopher Street Day (CSD) event in Berlin.

Thorsten Frei, the CDU/CSU parliamentary group leader, opposes the amendment, arguing it would "overburden" the constitution. He maintains that Article 3 already prohibits all forms of discrimination and that a symbolic change would not provide increased security for queer individuals. He also expressed opposition to flying the rainbow flag at the Reichstag.

In contrast, Werner Graf of the Green Party and members of the SPD advocate for the inclusion of sexual identity to provide permanent constitutional protection. While the Bundesrat previously approved a motion to expand the article, the final decision rests with the Bundestag, where a two-thirds majority is required.
