German Constitutional Court limits Afghan visa programme, upholds 2G+ rule

The Bundesverfassungsgericht’s second senate declared the Bundestag’s 2G+ health protection rule constitutional, rejecting earlier critiques and confirming the measure’s legality.

In a separate ruling on Germany’s Afghan admission programme, the court found that the Interior Ministry’s earlier “admission declaration” for Afghan nationals was not a binding administrative act. The decision allows the ministry to withdraw the declaration or assess visa applications individually, overturning the broad programme introduced under former foreign minister Annalena Baerbock.
