German Constitutional Court Rules No Fixed Speed Limit for Lawmaking
Germany’s Federal Constitutional Court (Bundesverfassungsgericht) ruled that the constitution does not prescribe a numeric tempo limit for parliamentary legislative procedures. The decision stemmed from a challenge by former CDU MP Thomas Heilmann, who argued that the accelerated adoption of the building‑energy (heating) law violated his rights as a legislator.
The court, led by Judge Ann‑Katrin Kaufhold of the Second Senate, held that the key requirement is the possibility of a meaningful exchange of arguments, not a specific number of days. Because Heilmann failed to demonstrate that the rapid process prevented effective participation, the claim was dismissed and the Bundestag retains flexibility in setting the pace of lawmaking.
