German court bans misleading pharmacy e-prescription discount ads

The Higher Regional Court of Frankfurt am Main has banned a mail-order pharmacy from using misleading advertising regarding “e-prescription discounts.” The court ruled that claims promising savings of up to 20 euros on co-payments were deceptive because they withheld essential information required for consumers to calculate their actual expected discount.

This legal dispute occurs amid rising costs for prescription medications in Germany. Under the GKV Contribution Stabilization Act, patient co-payments are set to increase by 50 percent starting next January, with minimum payments rising from 5 to 7.50 euros and maximums increasing from 10 to 15 euros.

While mail-order pharmacies like DocMorris and Shop Apotheke are leveraging these increases with aggressive marketing campaigns, local brick-and-mortar pharmacies have expressed significant concern. Traditional pharmacists argue that these discount battles threaten their business viability, noting that while they receive fixed surcharges on prescriptions, the increased co-payments collected from patients are passed entirely to health insurance providers rather than the pharmacies themselves.
