German court holds Google liable for false AI Overview content
A court in Aachen, Germany, has issued an injunction against Google, ordering the company to prevent its AI Overviews from spreading false information about a physician. The ruling comes after the AI system generated a detailed, false narrative attributing criminal conduct to the doctor, including allegations of sexual assault, harassment, and a large financial settlement.
According to the court, these accusations actually belonged to a different former executive. The AI-generated summary presented these falsehoods with a high degree of apparent precision, even though the linked source articles did not mention the plaintiff or attribute the crimes to him.
The court determined that because the AI provides an elaborate summary rather than acting as a simple index of links, the content can be considered Google’s own statement. This decision marks a significant legal precedent regarding the responsibility of search engines for content generated by artificial intelligence. The injunction is a preliminary measure, and Google faces potential fines of up to 250,000 euros for each violation.
