German court orders Cleantech Infrastruktur GmbH to pay investor in ThomasLloyd case

The Landgericht Osnabrück has issued a judgment ordering Cleantech Infrastruktur GmbH to pay an investor. The investor, who held several subordinated junior bonds issued by Cleantech Infrastruktur GmbH, was represented by lawyer Siegfried Reulein of the Nürnberg‑based law firm KSR.

The court rejected the company’s claim that it faced liquidity problems or a risk of insolvency that would justify a qualified subordination (Nachrang) exemption. After the contracts were terminated, Cleantech Infrastruktur GmbH withheld both principal repayments and interest, citing the qualified subordination clause. The court found the company had not sufficiently demonstrated the asserted financial distress and required it to make the owed payments.

KSR has previously represented hundreds of investors in lawsuits against the ThomasLloyd group and its intermediaries, securing judgments in favour of those investors. The latest ruling may enable other affected investors to pursue repayment through the courts.
