German court orders ex-son-in-law to pay compensation to in-laws
A German Higher Regional Court (Oberlandesgericht) has ruled that a former son-in-law must provide financial compensation to his former in-laws following the breakdown of his marriage. The case originated when the in-laws gifted a plot of land to a young couple to facilitate the start of their family life, with the expectation that the property would serve as a long-term family home.
After the marriage failed and a divorce was filed, the in-laws sought compensation for the son-in-law's share of the property. The man argued he could not pay because he had already transferred his share to his ex-wife.
The court ruled that while a formal withdrawal from the gift contract was not necessary, the contract could be adjusted because the fundamental circumstances envisioned at the time of the agreement—a lasting family home—had fundamentally changed. The court ordered a partial compensatory payment rather than the full amount requested.
