German court rejects neighbor's claim for leaf cleanup compensation

A regional court in Lüneburg, Germany, has ruled against a property owner seeking annual compensation for falling organic matter. The plaintiff requested over 3,540 euros per year to cover the costs of cleaning 50 meters of gutters and disposing of approximately 250 wheelbarrows of leaves and acorns.

The dispute centered on 14 pedunculate oaks, estimated to be 200 years old, located on a neighboring property. The trees reach heights of up to 25 meters, with branches extending over the plaintiff's land. The plaintiff argued that the volume of debris exceeded acceptable standards for neighborly coexistence.

Citing Federal Court of Justice (BGH) jurisprudence, the Lüneburg court determined that natural emissions and nature conservation do not provide a legal basis for such compensation claims.
