German Court Rules Israel-Nazi Comparison Not a Criminal Offense

A higher regional court in Zweibrücken, Germany, acquitted an Instagram user who posted images comparing the State of Israel’s actions to those of the Nazi regime. The posts featured Nazi symbols such as the swastika alongside Israeli flags and included hashtags #freepalestine and #gazaunderattack.

The court overturned a €2,400 fine imposed by a lower court in Ludwigshafen, stating that using symbols of unconstitutional organisations is not a criminal act when employed to sharply criticize Israel and to distance oneself from Nazi crimes. The ruling emphasized the protection of freedom of expression and warned against an overly broad interpretation of the criminal offence.

The decision sets a precedent for how hate‑symbol laws are applied in Germany when the symbols are used for political criticism rather than endorsement.
