German Court upholds street art project for Wuppertal apartment owners

The German Federal Court of Justice (BGH) has ruled in favor of a majority of apartment owners in Wuppertal regarding a street art project. The dispute centered on a decision made in 2024 to allow a large-scale painting on the north side of a high-rise building as part of a city-wide art initiative.

A single homeowner challenged the project, arguing that the artwork would fundamentally alter the residential complex, prevent the installation of air conditioning units on the facade, and increase visitor traffic. The plaintiff also raised concerns regarding the uncertain final appearance of the artwork.

The BGH's fifth civil senate rejected the revision, stating that a homeowner is not unfairly disadvantaged simply because they find a facade painting less aesthetically pleasing than others. The court noted that while determining if a structural intervention fundamentally changes a complex's appearance requires case-by-case analysis, in this specific instance, the individual was not more significantly affected than other residents.
