German banks ordered to pay compensation for mis‑advised UniImmo Wohnen ZBI fund

German courts have ordered banks to compensate investors for faulty advice on the open‑end real estate fund UniImmo Wohnen ZBI. The Landgericht Stuttgart sentenced a bank on 15 May 2025 to pay €5,095 in direct compensation after it mis‑represented the fund as safe as deposit‑insured savings and failed to disclose the 12‑month redemption notice and the 24‑month minimum holding period required by § 255 KAGB. The Landgericht Münster issued a similar ruling on 15 January 2026, ordering compensation for another investor mis‑advised about the same fund.

Lawyer Leonid Ginter, a specialist in banking and capital‑market law, advises affected investors to review the advice they received, especially if they were promised safety, capital preservation or short‑term availability. The Bundesgerichtshof has previously ruled that banks must proactively inform customers about the risk of a possible suspension of fund withdrawals. The banks involved have announced they will appeal the decisions.
