German courts rule on bakery labeling and residential zoning

German courts have issued rulings regarding consumer labeling and local zoning regulations.

The Higher Administrative Court of Koblenz ruled that rolls and similar baked goods in sealed packaging do not require a weight indication if the quantity of pieces is clearly visible and countable to the consumer or stated on the packaging. The court determined that since such items are typically purchased by count rather than weight, a weight specification is unnecessary. This decision invalidated a fine imposed by the State Office for Metrology and Regulation against a supermarket operator.

Separately, the Administrative Court of Karlsruhe ruled that an ice cream parlor is legally permitted to operate in or near a residential area. Despite neighbor complaints regarding noise and bicycle parking following the establishment's conversion from a bakery, the court found that noise levels remained within legal limits at a maximum of 54 decibels. The court also noted that the behavior of individual customers is not the responsibility of the business under building law.
