German courts rule on sick leave duties and time tracking

The State Labour Court of Baden-Württemberg (LAG) has ruled that employment contract clauses requiring sick employees to report ‘any urgent work’ are invalid due to excessive vagueness. The court decided that a warning issued to an employee for failing to mention pending material storage during a sick leave notification must be removed from their personnel file. The court noted that such clauses are too broad and unfairly require employees to report tasks that the employer could have identified independently.

Separately, the Federal Labour Court (BAG) has reaffirmed that employers must implement reliable, objective, and accessible systems to record daily working hours. This ruling aims to ensure compliance with occupational health and safety laws by allowing for the effective monitoring of working and rest periods. In the logistics sector, industry associations like BPEX are moving toward mandatory digital time tracking to replace handwritten documentation, despite ongoing concerns regarding potential system manipulation.
