German Courts Uphold Drunk‑Driving Conviction and Deny Motorcyclist Compensation
A driver who attempted to leave a parking garage while visibly intoxicated (blood‑alcohol level 1.98 ‰) was judged by the Bavarian Higher Regional Court to have committed a public‑traffic offence. The court rejected the driver’s argument that the garage was private property, imposed a fine and revoked his licence (case No. 204 StRR 102/26).
In a separate case, a motorcyclist who fell after his rear wheel caught on a damaged gully cover sued the city for more than €6,000 in damages. The court dismissed the claim, stating that municipalities must maintain roads in a reasonably safe condition but are not required to guarantee absolute safety, and that road users must adapt to evident road conditions.
