Federal Constitutional Court reviews AfD expulsion of Jan Wenzel Schmidt

The German Federal Constitutional Court has begun hearings to determine the legality of the AfD parliamentary group's decision to expel Bundestag member Jan Wenzel Schmidt. The court is examining the constitutional requirements a parliamentary group must meet when excluding a member.

Schmidt was expelled from the AfD parliamentary group on March 3, 2026, following allegations of nepotism within the party's Saxony-Anhalt branch. In an interview with the portal Nius, Schmidt described the party as a ‘Beutegemeinschaft’ (plunder community), alleging that mandates are shifted, jobs are arranged among associates, and funds are misappropriated.

In response, the AfD parliamentary group accused Schmidt of damaging the party's reputation. Schmidt has filed a lawsuit arguing that his rights as a member of parliament have been violated, noting that parliamentary group membership provides significant practical advantages for political work and participation.
