German Federal Court Upholds Coercive Detention of Anti‑Fascist Lina E

Germany's Federal Court of Justice (Bundesgerichtshof) confirmed the six‑month "Beugehaft" imposed on Lina E., an anti‑fascist activist, after she refused to testify before the Higher Regional Court in Dresden. The court rejected her constitutional complaint, stating that no concrete risk of self‑incrimination had been demonstrated and that speculative assumptions were insufficient to justify an exemption from testimony.

Lina E. had previously been convicted for participation in a left‑wing extremist group linked to attacks on right‑wing extremists in eastern Germany. After serving part of a five‑year sentence, she was released in May 2023, only to be re‑detained in June when summoned as a witness in a separate trial involving seven alleged members of the group known as "Antifa Ost." Her lawyer, Erkan Zünbül, argued that testifying could expose her to further prosecution, but the court maintained that the detention was lawful and will continue.

The decision reinforces the use of coercive detention in Germany to secure witness testimony in serious criminal investigations.
