German Federal Fiscal Court upholds strict recording rules for home offices
The German Federal Fiscal Court (Bundesfinanzhof) has confirmed strict documentation requirements for self-employed individuals claiming expenses for a home office. Under the ruling (Az. BFH – VIII R 6/24), expenses related to a home office must be recorded separately and individually from other business expenses.
The case involved a self-employed individual who utilized an attic space as a home office and a ground-floor library. While the taxpayer attempted to claim depreciation on immovable assets and home office expenses via an income-surplus calculation, the tax office did not fully recognize these costs.
The court upheld a previous decision by the Finance Court, stating that the taxpayer failed to meet the recording obligations stipulated in § 4 Abs. 7 Satz 1 of the Income Tax Act (EStG). Failure to comply with these specific documentation requirements means that such expenses are generally not tax-deductible.
