German Government Proposes Stricter Flight Noise Protection Rules

The German federal government has drafted an amendment to the Air Traffic Act to introduce new flight‑noise protection measures for civil aviation. The proposal adds a paragraph requiring local flight‑noise commissions to receive detailed information on planned or altered flight procedures and to publish their recommendations. It also creates financial incentives for using quieter aircraft types by differentiating airport fees based on noise impact, while maintaining a separate fee differentiation for pollutant emissions.

The draft calls for each commercial airport with an established noise protection area to form a commission that advises the licensing authority, the Federal Aviation Office and the air‑traffic organization. The Bundesrat has expressed concern that the requirement for the licensing authority to provide documents to the commission should be removed, arguing that the authority is not involved in setting flight procedures.
