German political debate intensifies over constitutional and regional LGBTQ+ protections

In Germany, political tension is rising regarding the legal protections for sexual identity. Following an Islamist attack near a Berlin Pride event in July 2026, which resulted in one death and 31 injuries, members of the SPD and Green Party have pushed to include ‘sexual identity’ in Article 3 of the Basic Law (Grundgesetz) to prevent discrimination.

While several federal states, including Berlin, Mecklenburg-Vorpommern, North Rhine-Westphalia, and Schleswig-Holstein, have supported a draft amendment, the CDU/CSU faction in the Bundestag has expressed opposition. The proposal currently remains in the Bundestag's legal committee.

In Bavaria, the FDP is criticizing the state government's ‘Action Plan for Sexual and Gender Diversity’ as insufficient. The FDP is demanding measurable goals, increased funding beyond the allocated 2.8 million euros for 2026–2027, and better protection against hate crimes, specifically targeting transphobia and homophobia.
