Germany plans Investment Protection Act to curb housing socialization

The German federal government is developing an Investment Protection Act designed to create significant legal hurdles for the socialization of large private housing stocks. Proposed by Interior Minister Alexander Dobrindt, the law aims to counter plans by the Berlin coalition of the Left, Greens, and SPD to expropriate properties from corporations owning more than 10,000 apartments.

Key provisions of the proposal include requiring state governments to prove a “compelling necessity” for socialization and demonstrating that all other means, such as investment and housing promotion, have been fully exhausted. Furthermore, the law would mandate that compensation be paid immediately in cash and based on full market value determined by expert appraisal.

The Federal Ministry of Justice has described the initiative as “constitutional uncharted territory,” noting a lack of precedent for such measures under Article 15 of the Basic Law. Critics, including SPD and Left party members, argue the law may be unconstitutional and could be overturned by the Federal Constitutional Court, as it seeks to limit the legislative powers of individual states.
