German traffic laws: Clarifying common legal misconceptions

Legal experts from ARAG have clarified several common misconceptions regarding traffic regulations in Germany.

Regarding the parking of bicycles and e-scooters, the Federal Administrative Court has ruled that parking on public spaces such as sidewalks or pedestrian zones is generally permitted. However, this is prohibited if it obstructs pedestrians, wheelchair users, or people with strollers, or if it blocks entrances, emergency routes, or driveways.

In terms of traffic signals, bypassing a red light is not always a violation. For instance, if a driver turns into a gas station or parking lot before the light and re-enters the road after the light, it may not constitute a red-light violation according to the Higher Regional Court of Hamm. However, using sidewalks, bike lanes, or shoulders to circumvent a red light remains a punishable offense. The legality depends on whether the bypass occurs on an independent path rather than within the traffic space regulated by the signal.
