Germany: Avoiding unemployment benefit suspensions after resignation

In Germany, employees who resign voluntarily typically face a 12-week suspension of unemployment benefits (Arbeitslosengeld I) unless they can prove a compelling reason for their departure. The burden of proof lies with the employee to demonstrate that the resignation was unavoidable under the circumstances.

Recognized valid reasons for avoiding a suspension include documented workplace bullying, health risks supported by medical certificates, the need to care for a close relative, or moving to be with a partner if the commute becomes unreasonable. Conversely, general dissatisfaction or vague prospects of new employment are generally not accepted as valid reasons.

The complexity of these regulations is particularly evident for foreign professionals, such as non-EU dentists, who may face conflicts between maintaining employment and preparing for mandatory professional licensing exams (Approbation). In such cases, the timing of resignations and the wording of termination agreements are critical to avoiding financial gaps.
