Germany considers organ donation opt-out model
German lawmakers are debating the introduction of an opt-out system for organ donation, known as the 'Widerspruchslösung'. Under this proposed regulation, individuals would be considered potential organ donors unless they actively register their refusal in an official organ donation register.
The Bundesrat passed a legislative initiative in July 2024 to reverse the burden of proof regarding donation consent. Currently, medical professionals must prove a person was a willing donor; the new model would require citizens to ensure their refusal is documented to avoid organ removal upon death. A group of 254 members of the Bundestag from various parties, including the CDU/CSU, SPD, Greens, and Die Linke, has expressed support for this change. The Health Committee is currently reviewing the matter.
