Germany debates data protection and transparency reforms

Moritz Hennemann, the new Federal Commissioner for Data Protection and Freedom of Information (BfDI), has presented his strategic agenda to the Bundestag Digital Committee. Hennemann aims to position data protection as a ‘trust catalyst’ that supports rather than hinders digitalization. His primary objectives include facilitating data-compliant state modernization, strengthening digital sovereignty, and providing early guidance for technological shifts.

Simultaneously, proposed reforms to the Federal Freedom of Information Act (IFG) are facing significant opposition. While CDU lawmaker Axel Knoerig defends the reforms as necessary to protect authorities from excessive inquiries, critics and civil society organizations warn that the changes could undermine transparency. The proposed measures include linking access to files to a ‘legitimate interest,’ introducing cost-recovery fees, and potentially limiting the effectiveness of mediation portals.
