The German Bundestag is debating a significant reform to organ donation laws, specifically the introduction of an opt-out system (Widerspruchsregelung). Under this proposed model, adults would be considered organ donors unless they have explicitly registered an objection. This marks the third attempt to implement such a change, following a failed initiative in 2020 and a second attempt interrupted by elections.

A cross-party group of 254 members from the CDU/CSU, SPD, Greens, and the Left Party supports the reform. Proponents, including former health ministers Jens Spahn and Karl Lauterbach, argue that current methods have not sufficiently increased donation rates and that making donation the default would save lives. Currently, Germany operates on an opt-in system requiring explicit consent.

However, a counter-proposal supported by over 50 MPs advocates for an alternative approach. This group opposes the opt-out model on the grounds of self-determination, arguing that silence should not be equated with consent. They propose instead to increase public education and mandate that citizens make an active decision regarding their donation status shortly after turning 18.

With more than 8,000 people currently on waiting lists for organ transplants in Germany, the debate remains a critical issue for the national healthcare system.
