Germany: Employee notification duties remain despite digital eAU implementation

Despite the implementation of the electronic incapacity for work certificate (eAU) in Germany, employees remain legally obligated to notify their employers of their inability to work. This notification must occur immediately on the first day of illness and before the scheduled start of work. While employees are not required to disclose their specific medical diagnosis, they must provide information regarding the expected duration of their absence to assist with organizational planning.

Under the digital system, employers retrieve the actual eAU data electronically from the relevant health insurance provider. While a medical certificate is generally required from the fourth day of illness, employers maintain the right to request a certificate starting from the first day.

Regarding financial support, employers are responsible for continued wage payment for up to six weeks, provided the employment relationship has existed uninterrupted for at least four weeks. If illness persists beyond this period, employees may be eligible for sick pay (Krankengeld), which can be provided for up to 78 weeks within a three-year period for the same illness.
