Germany extends statute of limitations for traffic violations

Germany has implemented a legislative change extending the statute of limitations for many traffic violations. Previously, many administrative offenses, such as speeding or illegal parking, expired after three months. Under the new regulations effective this summer, the standard limitation period has been increased to approximately six months.

Certain violations are subject to different timelines; for instance, technical infractions regarding vehicles or vehicle parts carry a longer statute of limitations of two years. Specific actions taken by fine authorities can also interrupt the limitation period, causing it to restart.

The Automobilclub von Deutschland (AvD) has criticized the change, noting that longer periods create uncertainty for drivers. The club highlighted that delayed notices make it more difficult for individuals to recall specific trips or accurately identify the driver, particularly in households with multiple users of a single vehicle. The AvD advises motorists to meticulously check any received fine notices for accuracy and to file an objection within two weeks if discrepancies are found.
