Germany faces challenges with Bürgergeld administration and fraud

German Jobcenters are facing challenges regarding the administration and potential abuse of 'Bürgergeld' (citizen's benefit) payments.

In one legal case, the State Social Court of North Rhine-Westphalia ordered a Jobcenter to resume payments to a severely disabled man. The agency had suspended his benefits after concluding he had moved to live with a girlfriend, based on evidence that his debit card was used 370 kilometers away from his residence. The court ruled that while card usage is an indicator, it does not constitute definitive proof of a change in residence. Furthermore, the court noted that if the agency believed it was no longer responsible for the claimant, it should have transferred the application to the appropriate local authority.

Separately, data from the Federal Employment Agency (BA) reveals significant organized fraud involving social benefits. Since 2022, more than 1,500 cases of organized benefit abuse by gangs, primarily from Eastern Europe and the Western Balkans, have been documented. In nearly 1,000 of these instances, Jobcenters filed criminal complaints. Experts suggest the actual number of cases is likely much higher due to unreported incidents and incomplete data from purely municipal Jobcenters.
