Germany faces legal uncertainty regarding assisted suicide

A lack of clear legal regulations in Germany is creating significant uncertainty for medical professionals regarding assisted suicide. Although the Federal Constitutional Court ruled in 2020 that the right to a self-determined death is a fundamental right, legislative action has stalled, with only one failed attempt in the Bundestag in 2023.

A recent study indicates that individuals seeking assistance are finding it increasingly difficult to obtain help from doctors. Approximately one-third of physicians are personally unwilling to assist in suicide, while another third remain uncertain. Notably, the proportion of doctors expressing doubt has risen from 18 percent to 32 percent.

Experts suggest that the current legal vacuum and the resulting fear of criminal prosecution among medical staff may lead to an increase in violent suicides, which can be traumatic for both the individuals and their surroundings. There is a growing call for the legislature to establish legal clarity to protect this fundamental right.
