Germany: Employment laws and social security regulations
In Germany, legal and financial frameworks govern employment and social support systems. Regarding employment law, a dismissal due to illness is legally possible under specific conditions. For a dismissal to be valid, an employer must demonstrate a negative health prognosis, show that expected absences will significantly impact business operations, and pass an interest balancing test to prove that continuing the employment relationship is unreasonable.
Regarding social welfare, approximately 769,000 recipients of basic security (Grundsicherung) are currently employed, a group often referred to as ‘Aufstocker’. These individuals receive supplementary payments from the Jobcenter when their earned income is insufficient to cover their standard living requirements, including housing and heating costs. The amount of this supplement is determined by calculating the difference between the individual's total needs and their income, after accounting for specific allowable deductions.
