Germany healthcare digitalization faces data privacy and legal hurdles

Discussions regarding the digitalization of the German healthcare system are highlighting significant concerns over data privacy and the legal framework for electronic patient records (ePA). Critics and medical associations have raised alarms regarding potential gaps in legal protection, noting that while certain professions like lawyers and journalists are explicitly protected under intelligence service reforms, doctors and pharmacists currently lack similar explicit protections for medical secrets. There is a noted legislative gap regarding the seizure protection of ePA data compared to the physical health card.

In a related development, the Law for Data and Digital Innovation in Healthcare (GeDIG) is being viewed as a potential tool to accelerate digitalization. BITMARCK CEO Andreas Strausfeld has noted that while the law aims to balance data utility with privacy, current legal restrictions may prevent AI real-world laboratories from reaching their full potential, specifically regarding the pooling of data from multiple health insurance providers.
