Germany Bundestag increases penalties for use of date rape drugs

The German Bundestag has passed legislation to increase the minimum prison sentence for using date rape drugs during robberies or sexual assaults. Under the new law, perpetrators will face at least five years of imprisonment, up from the previous minimum of three years.

The reform aims to classify these substances, such as GHB and GBL, as dangerous tools similar to weapons. This change follows a 2024 Federal Court of Justice ruling which had previously determined that such substances did not automatically qualify as dangerous tools under the criminal code.

Justice Minister Stefanie Hubig stated that the law sends a clear signal to perpetrators and victims, describing the use of such substances to facilitate sexual crimes as incredibly insidious. The legislation, which is scheduled to take effect on January 1, 2027, must still pass through the Bundesrat.
