Germany Justice Minister Hubig proposes “Only Yes Means Yes” law

German Federal Justice Minister Stefanie Hubig (SPD) has announced plans to further tighten sexual criminal law by transitioning from the current “No Means No” principle to an “Only Yes Means Yes” standard. Hubig stated in an interview with the Neue Osnabrücker Zeitung that sexual acts must be consensual, and this requirement should be explicitly reflected in the law.

The proposed reform aims to address situations where victims are unable to express their lack of consent, such as during states of shock. Hubig emphasized that silence does not constitute consent. She intends to present a legislative draft to the government factions later this year.

While there is already coalition agreement between the Union and SPD regarding this principle for minors, Hubig intends to extend the same regulations to adults without age-based distinctions. This follows a previous legislative reform in November 2016 that criminalized sexual acts performed against a person’s recognizable will.
