Germany proposes stricter penalties for sexual offenses

German Federal Justice Minister Stefanie Hubig (SPD) has unveiled a draft law aimed at tightening sexual criminal law. The proposal introduces several key changes to increase protection against sexual violence.

A central component is the criminalization of verbal and non-verbal sexual harassment. The draft seeks to penalize individuals who use sexually explicit statements or gestures intended to intimidate or harass others, with potential penalties of up to one year in prison or a fine.

The proposal also significantly increases minimum sentences for group offenses. Minimum sentences for gang rape would rise from two to five years, while other joint sexual assaults would see a minimum sentence increase from two to three years. Additionally, a five-year minimum sentence is proposed for rapes that result in pregnancy.

To ensure justice for victims who may delay reporting due to trauma or drugging, the draft proposes a uniform 20-year statute of limitations for rape and joint sexual assaults, an increase from the current five-year period in certain cases.
