Germany: Legal clarifications on Jobcenter housing and rent rights

Legal rulings and regulations in Germany clarify the rights of individuals receiving social security benefits regarding housing costs and rent reductions.

Under the German Civil Code, tenants are entitled to reduce rent in the event of significant defects, such as mold, heating failure, or water damage. However, for those whose housing costs are covered by the Jobcenter, the Federal Court of Justice has ruled that any financial advantage from a rent reduction may transfer to the benefit provider. Consequently, recipients should not spend these funds directly to avoid potential repayment claims from the Jobcenter.

In a separate ruling, the Social Court of Aurich determined that Jobcenters cannot reject a new apartment solely based on expected high heating costs. The court emphasized that when approving accommodation, the net or gross cold rent must be distinguished from heating costs. The decision mandates that authorities must focus on the base rent when assessing suitability, rather than preemptively denying coverage due to anticipated heating expenses.
