Germany: New Jobcenter rules and court rulings on benefit sanctions
New regulations regarding basic income security (Grundsicherung) in Germany establish a legal fiction of unreachability for individuals who miss three consecutive appointments at a Jobcenter without a valid reason. As of July 1, 2026, telephone calls, emails, or written responses are insufficient to resolve this status; only a personal appearance can end the fiction of unreachability.
If a person makes a personal appearance within the first affected calendar month, they may secure their benefit entitlement retroactively, though with a reduction in the standard requirement. Failure to appear personally after the initial period may result in the complete loss of benefits. The law requires that exceptional hardships and valid reasons be taken into account.
In a related legal development, the Saxon State Social Court (Sächsisches Landessozialgericht) upheld sanctions against a 16-year-old student. The court ruled that students aged 15 and older are subject to reporting obligations at the Jobcenter. In this specific case, the court confirmed that a 10 percent reduction in benefits was justified after the student failed to attend a scheduled appointment regarding her educational situation.
