Germany: Legal options for managing real estate during divorce or foreclosure

Property owners in Germany facing foreclosure or divorce have several legal and economic avenues to protect their assets. Foreclosure can be triggered by bank loan terminations due to financial difficulties or by a co-owner requesting a partition auction following a separation.

In divorce scenarios, several options exist for handling shared homes and mortgages. One partner may take over the property by paying out the other, provided the bank agrees to release the former owner from liability based on the remaining partner's income and collateral. Alternatively, parents may transfer the property to their children. If the children are minors, both parents and typically a family court must approve the transfer, though parents usually remain responsible for mortgage payments. For adult children to take over a mortgage, they must demonstrate sufficient income and security to the bank.

Other considerations include the early redemption of loans, which may require paying a prepayment penalty to the bank. Legal experts suggest that in foreclosure cases, owners should carefully verify the validity of the loan termination and the accuracy of the bank's claims to identify potential points for negotiation or legal objection.
