Germany reviews buyer protections amid real estate insolvencies
A wave of insolvency security measures has been announced across various sectors in Germany, with a notable concentration in the real estate industry. Companies such as Immobilien Weinand GmbH and Trost & Witt Real West GmbH are among those facing legal restrictions, including asset management orders and prohibitions on disposal, to secure assets before formal insolvency proceedings are opened.
In response to the risks posed by developer bankruptcies, the German federal government is reviewing ways to better protect homebuyers. Currently, consumers purchasing new builds through developers face significant economic risks, including construction halts, increased costs, and the potential loss of installment payments if a developer becomes insolvent. Consumer and owner associations have long called for reforms to developer contract law to address these protection gaps.
