Germany: Rules for Grundsicherung benefit applications
In Germany, the Jobcenter is legally prohibited from definitively rejecting applications for basic security benefits (Grundsicherungsgeld) solely due to missing documentation, such as bank statements or rental certificates. Under § 20 SGB X, authorities are obligated to investigate facts of their own motion and must request missing information from applicants within a reasonable timeframe.
While an incomplete application remains valid, applicants still maintain a duty to cooperate under § 60 SGB I. This includes providing necessary evidence of income, assets, and living situations. Benefits may only be partially or fully withheld if an applicant fails to cooperate despite being formally instructed to do so.
To qualify for these benefits, individuals must be at least 15 years old, reside in Germany, and be capable of working at least three hours per day. Eligibility is determined by whether the income of the applicant's 'Bedarfsgemeinschaft' (community of need)—which includes spouses, registered partners, or certain household members—falls below the subsistence level.
