German employers are facing a sharp increase in legal challenges related to the workplace. A recent analysis by insurance provider Arag shows that the number of labour‑court cases, especially dismissal‑protection lawsuits, has risen by more than 60% since 2021, with a 33% jump in 2025 alone. The trend reflects broader economic uncertainty, higher insolvency rates and announced job cuts across sectors, affecting not only low‑income workers but also middle‑ and higher‑income groups.

HR managers are also dealing with criminal allegations in the workplace, such as theft, fraud, sexual harassment and data misuse. Guidance stresses the need for structured documentation, confidentiality, proper evidence handling under data‑protection rules and early legal counsel before deciding on a criminal complaint. Both developments highlight the growing interplay between employment law and criminal law in German companies and the heightened risk for employee rights and corporate liability.
