Germany: Unemployment benefit risks for partial retirement

Employees transitioning from partial retirement (Altersteilzeit) to unemployment benefits (ALG I) face significant financial risks due to strict legal interpretations of German social security laws.

Under Section 159 of the SGB III, the Federal Social Court (Bundessozialgericht) has clarified that the end of a partial retirement agreement does not automatically constitute a ‘valid reason’ for unemployment. If an individual does not transition directly into pension payments and instead applies for unemployment benefits, the Federal Employment Agency may deem the unemployment to be ‘self-caused.’

Consequences for such individuals include a suspension of benefits for up to 12 weeks, a reduction of the total claim duration by up to one-quarter, and the loss of time toward pension insurance credits during the suspension period. The court's rulings emphasize that the plausibility of an immediate transition to retirement at the time the agreement was signed is a decisive factor.
