Germany's Justice Minister proposes Basic Law and descent law reforms
German Justice Minister Stefanie Hubig (SPD) has announced several legislative reform plans following a terrorist attack on the Christopher Street Day (CSD) in Berlin. A primary focus is the proposed amendment of Article 3, Paragraph 3 of the Basic Law to explicitly prohibit discrimination based on sexual identity.
Hubig is also seeking to reform descent law to ensure that children born to lesbian couples can have two legal parents from birth. While she is advocating for these changes, she has ruled out reforms to surrogacy laws due to strong opposition from the CDU/CSU Union.
In response to the rise of artificial intelligence, Hubig plans to reform procedural law to manage the influx of AI-generated legal documents and ensure courts are not overwhelmed by unstructured text. Additionally, she aims to improve the exchange of information between security agencies and the judiciary to better utilize intelligence regarding potential threats, particularly when making decisions on probation.
