German Private Landlords Overcharge Rent Comparable to Commercial Providers
New data from the legal service provider Conny, based on a sample of 9,350 cases where the German rent‑cap law (Mietpreisbremse) was violated, shows that private landlords are overcharging tenants at a level nearly equal to commercial landlords.
In 26.9% of the private‑landlord cases, the contract rent was at least double the official rent index. On average, private landlords demanded €338 too much per month, amounting to an excess of €4,061 per year for each tenant. Commercial landlords such as Deutsche Wohnen, Vonovia and Heimstaden charged slightly more, €348 per month or €4,178 annually. Conny’s founder Daniel Halmer noted that in at least 73% of the private‑landlord violations a professional property‑management firm was involved, indicating the breaches are not accidental.
The findings challenge the perception that only large corporate landlords breach the rent‑cap, highlighting a broader compliance problem across the German rental market.
