Getica 95 Com appeals dispute with Nuclearelectrica over energy deliveries

Getica 95 Com has filed an appeal following a first-instance legal loss in its dispute with Nuclearelectrica regarding the cessation of energy deliveries from the Cernavodă plant. The company is also launching a merits action concerning the existence and scope of force majeure.

Getica 95 Com reports daily losses between 1.5 and 2 million lei, as it must purchase more expensive energy to fulfill contracts with public entities, including water companies and municipalities. The supplier has been notified that deliveries will remain interrupted until October 1, 2026.

In the ongoing legal proceedings, Getica 95 Com claims Nuclearelectrica failed to deliver 23,217.60 MWh, valued at approximately 14 million lei. While Nuclearelectrica stated it had already returned advances for undelivered energy in August 2026, the supplier continues to seek damages for the financial impact of the supply disruption.
