Ghana Attorney-General appeals stay of former NAFCO CEO trial

The Attorney-General has filed an appeal with the Supreme Court to overturn a Court of Appeal decision that halted the criminal trial of former National Food Buffer Stock Company (NAFCO) CEO Hanan Abdul-Wahab Aludiba and his wife, Faiza Seidu Wuni.

The legal dispute follows an October 19, 2026, ruling by the Court of Appeal, which granted a stay of proceedings. This stay was requested by the defense after a High Court judge, Justice Francis Achibonga, refused to strike out the charge sheet. The defense argued the document was defective and lacked sufficient particulars to disclose the alleged offenses, though the High Court had previously ordered the prosecution to amend specific charges.

Deputy Attorney-General Dr. Justice Srem-Sai is challenging the appellate court's reasoning, arguing that a challenge to a charge sheet does not constitute an exceptional ground for staying a criminal trial. The Supreme Court's decision will determine whether the criminal proceedings can resume while the legal challenges regarding the charge sheet are pursued.
