Ghana Attorney General sues J.A. Plantpool over $2 million DRIP overpayment
The Attorney General and Minister for Justice, Dominic Ayine, has filed a lawsuit against J.A. Plantpool Ghana Limited and its Executive Chairman Joseph Siaw Agyepong, seeking the repayment of an alleged $2 million excess payment made under the District Road Improvement Programme (DRIP). The contract, signed on 12 February 2024, covered the supply of 2,420 units of earth‑moving equipment to Metropolitan, Municipal and District Assemblies, with a contract sum of US$178,704,739.50. A review of Schedule 1 revealed that the arithmetic total of the listed items amounted to US$176,704,739.50, indicating a $2 million overstatement.
The writ alleges that the state paid the inflated amount without receiving any corresponding equipment, service or consideration, constituting unjust enrichment. The Attorney General demands that the defendants jointly and severally refund the $2 million, plus interest at the commercial rate, and seeks any other relief the court deems appropriate. The defendants have not publicly responded to the allegations at the time of publication.
