Ghana High Court Rules clarify judicial power during vacations
A legal debate regarding the hearing of court cases during judicial vacations has centered on the interpretation of Order 79 of the High Court (Civil Procedure) Rules, 2004 (C. I. 47).
Under Order 79 Rule 1(1), the Chief Justice holds the authority to appoint any day, including during vacations, for the hearing of matters as circumstances require. This provision establishes that a vacation does not inherently prevent the hearing of cases. The rule grants the Chief Justice the discretion to determine if prevailing circumstances necessitate scheduling hearings during these periods, a power that remains subject to the Courts Act, 1993 (Act 459).
